TRIBUNAL STRIKES OUT PETITION AGAINST ANIEKAN UMANAH

The National Assembly Election Tribunal sitting in Uyo, Akwa Ibom State, today struck out the petition filed by Emem Israel Uboh and the Advanced Allied Party (AAP) against Hon. Aniekan Umanah and two other respondents.

The tribunal Chairman, Hon. Justice W.O.Akanbi Struck out petition No: EPT/AK/HR/07/19, based on the notice of withdrawal of the petition filed by the petitioners on April 2, 2019, whose application was not opposed by any of the Respondents’ Counsel who were all present in Court.

Mr. Emem Uboh had in his affidavit in support of the motion for withdrawal averred that his decision to withdraw the petition was sequel to his conviction and belief that the first respondent (Hon. Aniekan Umanah) won the elections clean and clear.

The tribunal accordingly granted leave to the Petitioners to withdraw the Petition and struck out the Petition pursuant to paragraph 29 of the 1st Schedule to the Electoral Act 2010 (as amended).

The first Petitioner, Emem Israel Uboh had in a 15 paragraph further affidavit in support of the motion for withdrawal, stated that he was sponsored by Hon. Emmanuel Ekon to file the Petition against Hon. Aniekan Umanah through his (Hon. Emman Ekon’s) lawyer, S.C Peters. and that he, (Emem Uboh) filed the motion for withdrawal of the Petition out of his own free will and “without any inducement or prejudice from any of the respondents”.

The tribunal after listening to the arguments of the first and second respondent’s Counsel on the issue of cost, granted cost in the sum of N5000 (five thousand naira) and N10,000 (ten thousand naira) against the first and second respondents respectively.
